Helping Virginia's faith communities build affordable housing by-right under the Faith in Housing Act
On April 22, 2026, Governor Abigail Spanberger signed Senate Bill 388 and House Bill 1279 into law, creating a groundbreaking pathway for faith-based organizations to develop affordable housing on their land.
Effective January 1, 2027, qualifying congregations can build housing by-right—meaning no special exception, conditional use permit, rezoning, or discretionary approval is required. This eliminates the most significant barrier that has prevented faith communities from serving their neighbors with affordable homes.

This law includes a sunset provision—it expires on January 1, 2031 unless reenacted by a future General Assembly. With the effective date of January 1, 2027, congregations have a limited window to take advantage of this streamlined process.
Virginia's faith communities own over 74,000 acres across 22,000 parcels. Research shows that in Northern Virginia, multifamily housing is prohibited on 65% of faith-owned properties under existing zoning. The Faith in Housing Act changes that equation—but only for those who act before the sunset.
